
The victims of a traffic accident have filed a lawsuit against both the motorist and the woman he was texting with when he caused the crash, according to Huffington Post. Now this is weird! Being accused as an accomplice to a crash when you're not even in the car is one case we'll probably never hear again, assuming this gets thrown out the court so fast like it didn't exist.
The driver, Kyle Best, a 19-year-old at the time of the accident, has already pled guilty to three violations of New Jersey law. 1. Using a mobile phone while driving, 2. Careless driving and leaving his lane. He hit a couple on a motorcycle with his pickup truck. Both the man and woman lost their left legs. At that time, Best was exchanging text messages with Shannon Colonna, according to phone records.
The couple's lawyer is arguing that Colonna knew she was texting Best while he was driving. But her lawyer maintains that she can't be held liable for the driver's decision to read the text when its not safe to do so.
